How removal works — three tiers, one truth.

Stop-sale (platform discretion): new buyers can't buy; everyone who already paid keeps access. Every use is on the audit record. ② Legal takedown — only on seven fixed grounds (NCII, CSAM, DMCA, court order, regulator, GDPR erasure, fraud): content goes dark for everyone including paid buyers, billing stops the same second and your current period is refunded automatically, platform fee included. Each removal is permanently recorded. ③ Erasing the record — doesn't exist. The platform may stop selling anything; it cannot take paid access away for its own convenience; and no removal, ever, can erase its own record.

In plain words — who is who. This summary explains; the numbered sections below are what governs.

If you sell

  • You made or own what you publish, and you are responsible for it. §2
  • You are the merchant of record: your taxes, your licences, your chargebacks. §2
  • You keep 90%; card processing (about 6%) is deducted by the payment processor at payout. Payouts run on a 7-day rolling delay; an approved refund comes from your balance, platform fee returned with it. §4
  • A pack that has ever been sold cannot be deleted at anyone's discretion — removal exists only on the seven legal bases in §3. Your subscribers keep the month they paid for. §1
  • Card statements read SAGACYCLES + your store name. §2
  • Content can be removed under seven legal bases, with an append-only record. §3 · §6

If you buy

  • You buy from the seller; SagaCycles runs checkout and the refund policy. §1
  • Cancel any time, self-serve. You keep the period you paid for — never clawed back. §1
  • What you bought stays bought; only gifted access can be withdrawn. Legally required removals are the one exception — and billing pauses the moment content goes dark. §1 · §4
  • Not as described — 7 days. Service not delivered — 14 days, full refund. Content taken down — billing pauses. §4
  • Export your data any time; deletion on request. §5

The platform

  • SagaCycles Inc provides the tooling, storefront and checkout — it is not a party to the sale. §1
  • A flat 10% at checkout. Never holds seller funds; never stores card data. §1 · §5
  • Does not write or edit pack content; its tools only flag and suggest, and nothing applies unless the creator accepts it. §3
  • Removal has three tiers: stop-sale (paid access intact) · legal takedown on seven grounds (blocks everyone, billing stops, final removal refunds the current period) · and no tier that erases the record. §3 · §4 · §6
  • Liability capped at fees paid in the prior 12 months; California law. §1

1. Terms of service

By using SagaCycles Platform (the "Service", operated by SagaCycles Inc) you agree to these terms. If you don't agree, don't use the Service.

The Service is operated from the United States and is directed to users in the United States. Selling requires a U.S. Stripe account; we may decline or close accounts outside the regions we support.

The service

SagaCycles Platform lets you capture work, turn it into runnable "packs", and optionally sell them to buyers. We provide the tooling and the storefront; we are not a party to sales between a creator and a buyer (see the Seller agreement).

Accounts

You sign in with Google or GitHub (or a platform-issued password). You're responsible for activity under your account and for keeping access secure. You must be at least 13 to use the Service and at least 18 to sell (Stripe requires it); by selling you confirm you are.

Platform fees

Using the Service may require a subscription. When you sell, the platform retains a transparent 10% application fee at checkout — the platform's only selling fee — disclosed before you publish. Payment processing is handled by Stripe under its own terms, and Stripe's processing fee is separate.

Disclaimers & liability

The Service is provided "as is", without warranties of any kind. To the maximum extent permitted by law, SagaCycles Inc is not liable for indirect, incidental, or consequential damages, and total liability is limited to the fees you paid us in the prior 12 months.

Subscriptions & cancellation

Memberships and pack subscriptions renew automatically each month until cancelled. You can cancel any time, self-serve — membership from your billing portal, a pack subscription from your library — and no email or phone call is ever required. When you cancel, you keep full access until the end of the period you already paid for; we never claw back a paid month, and you are not charged again.

What you bought stays bought

A pack that has ever been sold cannot be deleted by its seller — a seller cannot make what you paid for disappear. Access you paid for is revoked only through the refund and takedown outcomes described in §4 — and content is removed only on the seven legally grounded bases recorded in the removal ledger (§3) — never at the seller's or the platform's discretion. Only gifted (complimentary) access can be withdrawn.

Termination & changes

You may stop using the Service at any time. We may suspend or terminate accounts that violate these terms. We may update these terms; continued use after an update means acceptance.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction. If any provision of these terms is found unenforceable, the rest remains in effect.

2. Seller agreement

This applies when you publish anything to anyone but yourself (public, free, or paid).

How selling works

For paid sales you connect a Stripe Express account. Payouts go to your Express account; SagaCycles Inc operates the checkout and payment flow and retains a flat 10% application fee. You are the merchant of record for your sales: you are responsible for the content you sell (see the rights warranty below), for delivering what you promise buyers, and for your own taxes, business licences, and professional-licensing compliance in your jurisdiction. As merchant of record you also bear payment disputes (chargebacks) on your sales: a dispute and its card-network fee land on your Stripe account, not the platform's. Delivering what you promised — and refunding promptly when you can't — is the real chargeback defence. SagaCycles does not provide tax or legal advice.

Content licence (free plan)

Uploads land Public by default. While a file is set to Public or External you grant SagaCycles Inc a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, distribute and — at your direction — convert that content to text formats to audiences SagaCycles selects — including discovery surfaces, directories, the member library, and machine-readable indexes (e.g. for AI assistants). You keep ownership. The licence ends for an item when you delete it or set it Private — available on every plan, free. Private files are never distributed.

Rights & warranties

By publishing or selling an item you represent and warrant that you made or own it (or are licensed to sell it), and that it does not infringe anyone's intellectual property, privacy, or other rights. This is the attestation you confirm when you publish.

Indemnification

You agree to indemnify and hold harmless SagaCycles Inc from any claim, loss, or expense arising out of content you publish or sell, or your breach of this agreement.

Card statement identity

Charges for your sales appear on buyers' card statements as SAGACYCLES followed by your store name, set by the platform so buyers recognise the charge — an unrecognised statement line is the most common cause of a dispute, and disputes land on you as merchant of record. Keeping this descriptor recognisable is part of this agreement.

Circumvention

Service listings exist to win you buyers here. When an order originates from your SagaCycles page, payment should go through your page's checkout — that's what funds the platform (the flat 10%) and what earns you the verified review. Systematically steering platform-originated buyers to off-platform payment may result in removal of your listings.

Prohibited

You may not sell content that infringes rights, contains malware, harvests data, or violates the Acceptable use policy below.

3. Acceptable use & content policy

You may not upload, publish, sell, or distribute content that:

We may remove content and suspend accounts that violate this policy. Where the law requires it (e.g. apparent child sexual abuse material), we report to the appropriate authorities (NCMEC) and preserve evidence as required.

Platform tools and your content

SagaCycles does not write or edit the content of packs. Its tools may measure a file (size, dates, fingerprint), convert a file you upload to a text format at your direction (a mechanical conversion, not an edit — converted files are saved as private until you review and publish them, and the fingerprint of your original is recorded), or suggest a change to you; no suggestion is applied unless you accept it. Content published on the platform is the creator's own work and statement, and each publication is recorded with the fingerprint of what was published.

Non-consensual intimate imagery (TAKE IT DOWN Act)

Publishing an intimate visual depiction of an identifiable person without their consent — including AI-generated depictions — is prohibited here and may violate federal law (the TAKE IT DOWN Act). To request removal, email [email protected] with the subject line NCII, the content link, and a statement that the depiction is of you (or someone you are authorised to represent) and was published without consent. On a valid request we remove the reported depiction within 48 hours, and make reasonable efforts to remove identical copies. We report apparent child sexual abuse material to NCMEC as required by law. (The platform stores text formats only — images and video cannot be uploaded — which limits, but does not remove, this obligation.)

Removal record

Every removal or restoration is entered in an append-only ledger with a fixed legal basis — one of: NCII, CSAM, DMCA, court order, regulatory demand, GDPR/CCPA erasure, or fraud/policy enforcement. The ledger is designed to be append-only — the database rejects edits and deletions in the normal course of operation — and supports our response when a court, regulator, or rights-holder asks when and why we acted.

Report content: email [email protected] with the pack link and what's wrong (subject: REPORT). Copyright complaints go through the DMCA process in §6.

4. Refund policy

Items are digital goods delivered instantly. Because SagaCycles Inc handles checkout, refunds are coordinated through the platform:

Refunds are reviewed by a person and issued through Stripe; an approved refund reverses the seller's payout and the platform fee for that sale.

5. Privacy policy

What we collect

How we use it

To provide the Service, process sign-in, enable sales, prevent abuse, and meet legal obligations. We don't sell your personal data.

Processors

Google and GitHub (sign-in), Stripe (payments), Cloudflare (hosting, storage, AI, including format conversion of uploads), Resend (email delivery — pack-update notices and account mail). Each processes data under its own terms.

Your rights

Depending on your jurisdiction (e.g. GDPR/CCPA) you may access, correct, export, or delete your data. While signed in you can download your whole vault as JSONL at any time — free and paid accounts alike — at /api/me/export. To request deletion, email [email protected].

Tracking & "Do Not Track"

We run no third-party analytics or advertising trackers and set no tracking cookies; the only cookie is your sign-in session. Because we do not track you across sites, there is nothing for a "Do Not Track" signal to change — we treat every visitor as if it were sent.

Changes to this policy

The effective date is at the top of this page. Material changes are announced here and, for signed-in members, by email to the address on the account before they take effect.

Retention

We keep your data while your account is active. To close your account, email [email protected] (export your vault first); within 30 days we delete or anonymize your content — backup copies age out within a further 14 days — keeping only what legal/financial record-keeping requires.

6. Copyright / DMCA

We respect intellectual-property rights. Creators warrant that they own or are licensed for everything in a pack; that attestation is recorded with a policy version and timestamp each time a pack is published.

What a notice must include

Your contact details; identification of the copyrighted work; the URL or pack link of the material you say infringes; a statement that you have a good-faith belief the use is not authorised; and a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act for them. You may also file programmatically by POSTing JSON to our notice endpoint (GET it for the required fields).

What happens next

On receipt of a complete notice we expeditiously disable access to the reported pack — every file in it goes dark while we review. The notice appears in the creator's account (/api/me/dmca-notices, with the notice id), and the creator may submit a counter-notice. If a counter-notice is filed and the complainant does not pursue a court order, access is restored after the statutory waiting period. We keep an auditable record of every notice, takedown, counter-notice and restoration.

Repeat infringers

We maintain and enforce a repeat-infringer policy: upheld notices are recorded as strikes against the account, and an account that accumulates them has its selling privileges terminated.
